Terms & Conditions - OUTSPOKEN Publishing

1. Agreement to Terms

By accessing or using the OUTSPOKEN Publishing website (www.outspokenpublishing.com) and purchasing any products or services, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our website or services.

OUTSPOKEN Publishing is operated by OUTSPOKEN Publishing, located in Ontario, Canada.

2. Services Offered

OUTSPOKEN Publishing offers the following services:

  • Solo Author Publishing Packages (Editing + Publishing, Writing + Editing + Publishing)
  • Collaborative Book Publishing (contributing to our books or leading your own)
  • Write Your Damn Book Course (digital self-paced program)
  • Collaborative Book Blueprint Course
  • 1:1 Coaching Calls
  • Digital Downloads (guides, audio files, templates)

All services and products are described on our website. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

3. Purchases and Payment

3.1 Pricing

All prices are listed in Canadian Dollars (CAD) unless otherwise specified. Prices are subject to change without notice, but changes will not affect orders already placed.

3.2 Payment

Payment is processed through Kajabi Payments. By providing payment information, you authorize us to charge the total amount due for your purchase.

3.3 Payment Plans

Some services offer payment plan options. If you choose a payment plan:

  • You authorize automatic recurring charges on the scheduled dates
  • Failure to make scheduled payments may result in suspension of access to services or products
  • Payment plan obligations remain in effect even if you stop using the service

3.4 Taxes

Applicable taxes (including HST/GST) will be added to your purchase where required by law.

4. Refund and Cancellation Policy

4.1 No Refunds

All sales are final. Due to the digital and custom nature of our products and services, we do not offer refunds once:

  • Digital products have been accessed or downloaded
  • Publishing packages have begun (deposit is non-refundable)
  • Coaching calls have been scheduled or completed
  • Course content has been accessed

4.2 Service Delivery

5. Intellectual Property

5.1 Course Content and Materials

All content provided through OUTSPOKEN Publishing (including but not limited to courses, templates, audio files, videos, worksheets, and written materials) is the intellectual property of OUTSPOKEN Publishing and is protected by copyright laws.

You may:

  • Access and use materials for your personal, non-commercial use
  • Download materials for your own reference

You may not:

  • Reproduce, distribute, or share course materials with others
  • Resell, repurpose, or claim materials as your own
  • Use materials for commercial purposes without written permission

5.2 Your Content

When you submit your manuscript, story, or other written content to OUTSPOKEN Publishing for editing or publishing services, you retain ownership of your intellectual property.

By engaging our services, you grant us:

  • Permission to edit, format, and publish your work as agreed
  • The right to use excerpts or testimonials for marketing purposes (with your permission)

6. Publishing Services

6.1 Manuscript Requirements

For publishing packages, you are responsible for providing:

  • Your manuscript in the agreed-upon format
  • Any necessary permissions for third-party content
  • Timely responses to editing and revision requests

6.2 Timelines

Project timelines are estimates and may vary based on:

  • Manuscript complexity and length
  • Your responsiveness to revision requests
  • Scope of work required

We will communicate any significant delays as soon as possible.

6.3 Author Responsibilities

As the author, you are responsible for:

  • The accuracy and legality of your content
  • Obtaining necessary permissions for quoted material, images, or third-party content
  • Final approval of your manuscript before publication
  • Compliance with all applicable laws regarding your book's content

7. User Conduct

You agree not to:

  • Use our services for any illegal or unauthorized purpose
  • Share login credentials for digital products or courses
  • Harass, abuse, or harm other users or OUTSPOKEN Publishing staff
  • Attempt to access restricted areas of our website or systems
  • Upload or transmit viruses, malware, or harmful code

8. Privacy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

9. Limitation of Liability

To the maximum extent permitted by law:

OUTSPOKEN Publishing is not liable for:

  • Any indirect, incidental, or consequential damages arising from your use of our services
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from errors, omissions, or delays in service delivery

Our total liability for any claim related to our services shall not exceed the amount you paid for the specific service in question.

  • Your use of our services

  • Content you provide (including manuscripts and submissions)

12. Modifications to Terms

13. Termination

We reserve the right to terminate or suspend your access to our services at any time, without notice, for:

Upon termination:
